“I would like to ask MPs - There are disputes over tens millions of GEL as a result of inspection by Regulation Agency. These sums are appealed for years only because the amount is not returned to the budget. Is that right?”, - stated Deputy Minister of Health, Ilia Ghudushauri at the Committee Meeting in the Parliament of Georgia where the topic of legislative changes concerning Regulation Agency for Medical and Pharmaceutical Activities was discussed by MPs.
As stated by Ilia Ghudushauri, in many cases appellation of the protocols and prolongation of the processes are done on purpose, so that not to return funds to the budget.
Ilia Ghudushauri presented to MPs statistical data of court disputes and noted that out of appealed protocols, 97% of decisions made by the Regulation Agency was considered by court to be valid.
“Since January 1, 2022 up to present the Regulation Agency compiled around 2,700 protocols on administrative irregularities. Out of this, 120 protocols are under court consideration by this time. In 60 cases, the other party was uncharged, in the rest of cases, the court found the decision of the Regulation Agency to be valid, which is around 97% of the protocols compiled by the Agency.
In most cases (80-85 %), court decision was appealed despite the fact that the other party was aware of low probability of winning. The other party appeals protocols of the Regulation Agency just to stall for time.
Besides, in relation to the National Health Agency, as a result of inspection done by the Regulation Agency there are disputes over tens millions of GEL.
I can understand fear of the private sector and disapproval of the fact that penalty for some clinics may be very high and that they will have difficulty in functioning.
Though, I would like to ask MPs - there are disputes over tens millions of GEL as a result of inspection by Regulation Agency. These sums are appealed for years only because the amount is not returned to the budget. Is that right? They resort to different legal ways so that the decision is not enforced and the sum is not returned to the budget. Our motivation for immediate enforcement is to return these sums to the budget.
The Regulation Agency has this right granted by the State and I think it is embarrassing to ask questions in this regard.
